The gap
Foreign buyers acquiring residential property within the restricted zone, which includes essentially all coastline, generally hold title through a bank trust known as a fideicomiso, or through a Mexican corporation where the use qualifies. Neither is exotic. Both are routinely mishandled.
Closings run through a notario público, a public official with far broader authority than a Canadian notary. Land with ejido origins carries title risk that does not always surface in a casual search. Closing costs, acquisition tax and trust set-up are materially different from what a Canadian buyer expects.
None of this is a reason not to buy. It is a reason not to buy without representation on the Mexican side.
The position
Our principal is a licensed real estate professional in Baja California Sur and in British Columbia, lives in Metro Vancouver, and works in both English and Spanish.
For a Canadian buyer that means the person explaining the trust structure is the same person who will be at the closing, in the country, in the language, and who is still reachable from your time zone afterwards.
For a Mexican seller or developer it means a counterparty who can actually reach Canadian capital rather than waiting for it to wander in.
The market
Los Cabos has direct air access from Western Canada, a mature tourism economy, and a rental market that can carry part of the holding cost for owners who want it to. It attracts Canadian and American buyers looking for a second residence, a retirement position, or a yield-bearing asset in USD-linked terms.
It is not for everyone. If you need liquidity on short notice, or you are unwilling to hold through a soft season, coastal Mexico is the wrong instrument. We will say so.
